PERSONAL DATA MANAGEMENT

The administrator, i.e. the entity deciding how your personal data will be used, is KONSTAL PLESZEW SP. Z O.O. SP.K with its registered office in Pleszew at st. KALISKA 184 63-300 Pleszew (hereinafter "KONSTAL") owner and operator of online trading platforms available at the addresses www.kotly24.pl, www.kotlarstwo.info and selling through the Allegro.pl portal with login kotlarstwo_info (hereinafter "Internet sales platforms" ).

What is the purpose and legal basis for the processing of your personal data by KONSTAL?

We process your personal data because it is necessary to perform the contract concluded with you, including: enabling the provision of electronic services and the execution of orders, including transactions and payments for items purchased by you; setting up and managing your account or accounts, and providing support for your account, transactions and solving technical problems; online and installment payments, if you have chosen this payment option when placing your order; handling complaints when you submit one; handling statutory returns of goods; handling requests that you send to us (e.g. via the contact form); providing marketing services, sending current promotional offers, etc .; contacting you, including for purposes related to the provision of services. In addition, the law requires us to process your data for tax and accounting purposes.

We also process your personal data for the purposes indicated below, based on the legitimate interest of KONSTAL, which is: conducting marketing activities towards you, including direct marketing of own services or goods; contacting you, including for purposes related to permitted marketing activities, through available communication channels, in particular and with your consent - by e-mail and telephone; support for credit services; providing payment services; ensuring the security of the services we provide to you electronically, including enforcing compliance with the internal rules of KONSTAL and counteracting fraud and abuse and ensuring traffic safety; conducting research and analysis, including in terms of the functionality of the KONSTAL online trading platforms, improving the operation of services or estimating the main interests and needs of visitors; handling your requests, in particular to the user service department and via the contact form in a situation where they are not directly related to the performance of the contract; organization of loyalty programs, competitions and promotional campaigns in which you can take part; debt collection; conducting court, arbitration and mediation proceedings; conducting statistical analyses; storing data for archiving purposes, and ensuring accountability (showing compliance with our obligations under the law).

If you agree, we process your personal data in order to: save data in cookie files, collect data from websites and mobile applications; organization of competitions and promotional campaigns in which you can take part. You can withdraw your consent to the processing of personal data at any time in the same way as you expressed it. We will process your personal data until you withdraw your consent.

Do you have to provide us with your personal information?

We require you to provide the following personal data in order to be able to conclude and perform the contract concluded with you, and thus provide you with the service: e-mail address, password, name and surname, telephone number, address of residence, delivery address (in the case of a regular account) or e-mail address, login, password, telephone number and information about the company and its address and delivery address (in the case of an account for companies). If for some reason you do not provide this personal data, unfortunately we will not be able to conclude a contract with you, and consequently you will not be able to take advantage of our offer. If required by law, we may require you to provide other data necessary, for example, for accounting or tax reasons. Apart from these cases, providing your data is voluntary.



Where do we get your data from?

We received them from you when setting up an account on our online sales platforms and when placing orders by phone, fax, e-mail or directly at the headquarters of our company KONSTAL.



What rights do you have towards KONSTAL regarding the processed data?

We guarantee the fulfillment of all your rights under the General Data Protection Regulation, i.e. the right to access, rectify and delete your data, limit their processing, the right to transfer them, not to be subject to automated decision-making, as well as the right to object to the processing of your personal data.

You can exercise these rights when:

- regarding the request for rectification of data: you will notice that your data is incorrect or incomplete;

- regarding the request to delete data: your data will no longer be necessary for the purposes for which they were collected by KONSTAL; you withdraw your consent to data processing; you object to the processing of your data; your data will be processed unlawfully; the data should be deleted in order to fulfill the obligation resulting from the law or the data was collected in connection with the provision of electronic services offered to the child;

- regarding the request to limit data processing: you will notice that your data is incorrect - you can request the restriction of the processing of your data for a period allowing us to check the correctness of this data; your data will be processed unlawfully, but you will not want it to be deleted; We will no longer need your data, but you may need it to defend or pursue claims; or you object to data processing - until it is determined whether the legitimate grounds on our part override the grounds for objection;

- regarding the request to transfer data: the processing of your data takes place on the basis of your consent or a contract concluded with you, and when the processing is carried out automatically.

 

In what situations can you object to the processing of your data?

You have the right to object to the processing of your personal data when: the processing of your personal data is based on a legitimate interest or for statistical purposes, and the objection is justified by the particular situation in which you have found yourself, your personal data is processed for direct marketing, including being profiled for this purpose. Remember that you can exercise your right to object from May 25, 2018.



Who do we share your personal data with?

We provide your personal data to the parties to the transactions you conclude with KONSTAL and to entities supporting us in the provision of services, i.e. those that provide payment, credit and insurance services, provide parcel transport services, support the service of KONSTAL users, support the promotion of offers, cooperate in marketing campaigns . We may transfer your personal data to public authorities fighting against fraud and abuse.

How long do we store your personal data?

We store your personal data for the duration of the contract concluded with you, as well as after its completion for the purposes of: pursuing claims in connection with the performance of the contract, performance of obligations under the law, including in particular tax and accounting, preventing abuse and fraud, statistical and archiving, for a maximum period of 10 years from the date of completion of the contract. We store your personal data for marketing purposes for the duration of the contract or until you object to such processing, whichever occurs first. In the case of organizing loyalty programs, competitions and promotional campaigns in which you can take part - we will process your data for the duration of their duration and the period of settlement of prizes. For the purpose of accountability, i.e. to prove compliance with the provisions on the processing of personal data, we will store data for the period in which KONSTAL is obliged to keep data or documents containing them to document the fulfillment of legal requirements and enable control of their fulfillment by public authorities. If we provide you with support in obtaining a loan, the period of storing your data for this purpose will be equal to the period of applying for this loan.



Do we transfer your data to countries outside the European Economic Area?

Your personal data, such as the IP address, will be transferred outside the European Economic Area to Google LLC based on appropriate legal safeguards, which are standard contractual clauses for the protection of personal data, approved by the European Commission.



Do we process your personal data automatically (including through profiling) in a way that affects your rights?

Your personal data will be processed in an automated manner (without profiling), however, it will not have any legal effects on you or similarly significantly affect your situation.



All personal data collected from Users are sent to the system using a secure SSL protocol. All information about Users stored on the KONSTAL server is protected against access by unauthorized persons. The only persons authorized to use this data are employees properly trained by the website owner.



Do we process your personal data automatically (including through profiling) in a way that affects your rights?



Your personal data will be processed in an automated manner (without profiling), however, it will not have any legal effects on you or similarly significantly affect your situation.



COOKIE FILES (so-called ,,cookies”)

1. The website does not automatically collect any information, except for information contained in cookie files.
